Jimmy Buffett’s widow, Jane, has appealed a Palm Beach County judge’s order allowing a co-trustee to use $2 million from the trust for legal fees.

Jimmy and Jane Buffett were married for 46 years and were longtime part-time Palm Beach residents. Jane has filed an appeal in state court after a Palm Beach County judge said co-trustee Richard Mozenter can use trust money to pay his legal fees in the case. The motion to the Fourth District Court of Appeals is the latest legal salvo as Jane Buffett and Richard Mozenter try to oust each other from their positions as co-trustees.

Mozenter should not be able to make unilateral decisions about how to spend money from the trust, based on the trust’s terms, Jane Buffett’s attorneys argued in the state court filing. A majority decision is needed before an action can be taken by the trust, her attorneys said in that motion.
